Michigan Court of Claims strikes Rule 168.48: electronic pollbooks must be kept 22 months, not deleted in seven days

On Monday 2 November Judge Michael J. Riordan held that Mich. Admin. Code R. 168.48—which required clerks to delete electronic pollbook software and files within seven days of canvass—conflicts with MCL 168.811’s 22-month retention duty and is invalid. He permanently enjoined enforcement and ordered EPBs kept with metadata intact. He rejected a federal-preemption theory under 52 U.S.C. § 20701.
