Dutch cabinet sends nitrogen bill to the Tweede Kamer: sector emission targets to 2035, under-threshold from mid-2027 if conditions met

On 3 November the Dutch cabinet said it is sending a bill to the House of Representatives that replaces Kritische Depositiewaarde (KDW) targets in law with sector emission targets for agriculture, industry and mobility, to be met by 2035. It also adopted the design programme of measures and aims to bring in a computational under-threshold on 1 July 2027 if the package is finalised.

Dutch Council of State tells cabinet to withdraw its Box 3 savings-and-investment tax plan and start again for 2030

In advice published today, the Raad van State’s Advisory Division says the cabinet’s amendment (‘novelle’) to the Actual Return in Box 3 bill is rushed, creates a temporary hybrid system that would need 252 FTE and about €31 million more to run, and that the Tax Administration itself calls unworkable for 2028. It advises withdrawing the bill and moving to a new system in one step in 2030; the current flat-rate system with rebuttal would continue in 2028 and 2029.

Dutch cabinet plans to shrink the national civil service by about 25,000 full-time jobs by 2035

In a letter to parliament published 26 October, State Secretary Eric van der Burg says the central government must save €900 million in 2027, rising to €3.5 billion a year from 2035, which the cabinet estimates means about 25,000 fewer full-time posts. Police and defence are exempt. The letter also promises a law within two years to let agencies share residents’ data more easily, fewer advisory bodies, at least 500 rules cut or simplified a year, and AI savings targets in early 2027.

Dutch Senate passes return-and-detention law that ends court-ordered penalty payments for late asylum decisions

On 13 October the Eerste Kamer passed the Return and Immigration Detention Act (34.309) and its amending novelle (35.501). The amendment abolishes the dwangsommen, penalty payments courts can order the IND to pay when it misses asylum decision deadlines. The laws also give immigration detention its own administrative-law regime, allow 23-hour lockdowns in serious disorder, and widen “undesirable alien” declarations.

The Netherlands revives its heat-pump rule: from 2029, many homeowners replacing a gas boiler will need a smart hybrid heat pump

In a 7 October 2026 letter to parliament, Housing Minister Elanor Boekholt-O’Sullivan said a new boiler alone will no longer meet the building code when an old one is replaced in homes not heading for a heat network. The rule would apply from 2029 at the earliest. Apartments and listed monuments are exempt at first. Who pays, and how much, is still being worked out.

EU court: the Netherlands cannot freeze asylum claims from people under Ukraine temporary protection

In Case C-249/25 (1 October 2026), the Court of Justice ruled that automatically suspending the asylum claims of people who already hold EU temporary protection breaks EU law. Normal decision deadlines apply, though states may extend them or work through a backlog in phases. The Dutch asylum minister told NOS the ruling means about 140,000 shelved claims must now be processed.
