Judge strikes CMS’s narrower ‘medically frail’ test for Medicaid work-requirement exemptions

In a 29 October ruling, U.S. District Judge Richard Stearns (D. Mass.) held that CMS had no authority to require people who are blind, disabled, or have a substance-use disorder, a disabling mental disorder or a serious medical condition to also prove their condition “significantly impairs” their ability to meet the 80-hour monthly requirement. He vacated that language and issued a permanent injunction. CMS’s 12-month look-back on medical records and its one-self-attestation limit survived. The work requirement still starts on 1 January 2027.
