HHS finalises §504 rule: gender dysphoria without a physical impairment is not a covered disability

Published in the Federal Register on 3 November (effective 4 January 2027), HHS’s Office for Civil Rights amends 45 CFR part 84 so that the statutory exclusion of “gender identity disorders not resulting from physical impairments” expressly encompasses “gender dysphoria not resulting from a physical impairment.” The rule responds to ambiguity created by the 2024 §504 preamble and leaves gender dysphoria caused by a physical impairment outside that exclusion.
