Dutch Senate passes return-and-detention law that ends court-ordered penalty payments for late asylum decisions
On 13 October the Eerste Kamer passed the Return and Immigration Detention Act (34.309) and its amending novelle (35.501). The amendment abolishes the dwangsommen, penalty payments courts can order the IND to pay when it misses asylum decision deadlines. The laws also give immigration detention its own administrative-law regime, allow 23-hour lockdowns in serious disorder, and widen “undesirable alien” declarations.
